Terms of Sale

These terms and conditions outline the rules and regulations for the purchase of any goods, services, courses, trainings, audio, or video content from Gillian Shields.

Gillian Shields is located: P.O. Box 17032 Yonge King, Toronto Canada, M5E 1Y2.

By purchasing from Gillian Shields, you accept these terms and conditions in full. Do not purchase from Gillian Shields if you do not accept all of the terms and conditions stated here.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person making the purchase and accepting the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company/Gillian Shields. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing law of Canada. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Contract and Intellectual Property

Unless otherwise stated, Gillian Shields and/or it's licensors own the intellectual property rights for all material distributed by Gillian Shields. This includes written material, text, design, photos, videos, digital content, and interactive features, and are considered collective works under Canadian and other copyrighted law. All intellectual property rights are reserved. You may view and/or print pages delivered by Gillian Shields for your own personal use subject to restrictions set in these terms and conditions.

By purchasing any audio, video, digital, course content from us, we grant you a licence (which is limited, revocable, non-exclusive, non-transferable) to listen to, download or stream such content to your computer and/or other device(s) solely for your personal, non-commercial use. You agree to not otherwise copy, reproduce, distribute or use the content other than as set out in this contract. You must not sell, transfer, lease, modify, distribute or publicly perform the content in any manner and you must not exploit it commercially. You agree to not tamper with the content or create any derivative works therefrom.

We may terminate your license to use any purchased products if you breach this contract.

Product/Service Sales or Downloads

Any product/service/membership purchased from Gillian Shields, or downloaded via the website is non-refundable, unless otherwise specifically stated such as in a service/program/membership contract or agreement.

All goods, services, audio or video content purchased from Gillian Shields is non-refundable and non-exchangeable.

Payment

All goods or services sold by us are charged in Canadian dollars. If you are located in Canada you will be charged Canadian Harmonized Sales Tax.

You will provide payment prior to receiving any goods or services from Gillian Shields.

If you are on a monthly payment plan, your method of payment used to initially purchase the product or service will be charged on a monthly basis until full payment has been made. If payment fails, it will be re-attempted. If payment is not provided, we will contact you to resolve payment. If payment is not provided within 7 days, your access to the product/service will be revoked until payment is provided.

Life-Time Access to Courses, Programs, and Trainings & Updates to Content

Any trainings, courses, or programs of Gillian Shields, stated as being ‘lifetime’ access means that you will have unlimited access to the content, including any future updates for the lifetime of the course.

Gillian Shields strives to improve her work and may evolve how she supports clients and students in their growth. As a result, Gillian Shields holds the right to update any of her course, program, or training content, at any time after you have purchased. Updates include revisions to existing content, or addition of new content. If after you have purchased, Gillian Shields decides to update content, you will be notified by email of any such updates.

Disclaimer

The content displayed/provided through Gillian Shield’s goods, services, audio or video content is for educational purposes only and is not deemed as professional advice as per that given by a professional (e.g., counsellor, psychologist, therapist, etc.). Gillian Shields is a coach/mentor, and is not a therapist, psychotherapist, psychologist, psychiatrist or a member of any regulated health profession and will not provide any such services to you. Gillian Shield’s services, courses, trainings, or digital products are not a substitute for counselling, psychotherapy, mental health care, substance abuse treatment, or any other psychological, physical, or emotional treatment/therapy.

The services and digital products provided is developed strictly for educational and personal development purposes only. Results of any trainings or programs vary. You are solely responsible for your own results and it is your decision on how you incorporate the information and tools provided to you, into your life.

Confidentiality and Privacy

You agree to our privacy policy here.

Gillian Shields respects Your privacy and insists that You respect Gillian Shield’s. Information, including any identifiable/contact information, that the You share with the Gillian Shields as part of services, program, or a membership will be kept confidential by Gillian Shields. Gillian Shield’s may share quotes or messages of participants inside a program or membership, and in such case, you will only be identified by your first name and country of residence.

If you have purchased a membership or program where you may interact will be other participants, you are asked to respect the privacy of those individuals and keep personal information confidential. Please note that due to the nature of a community or membership group, your confidentiality and privacy cannot be guaranteed. If you are disruptive, disrespectful or violate the group rules of the community membership, Gillian Shields has the right to remove you from the group and membership without refund or notice.

Limitation of Liability

You understand that any product or service from Gillian Shields is only an educational. You release Gillian Shields, as well as the venue where the Program is being held (if applicable) and any of its owners, executives, agents, or staff (hereinafter “Releases”) from any and all damages that may result from any claims arising from any agreements, all actions, causes of action, contracts, claims, suits, costs, demands and damages of whatever nature or kind in law or in equity arising from participation in the Program. You accept any and all risks, foreseeable or unforeseeable. You agree that Gillian Shields will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of Gillian Shields’s services.

Jurisdiction

This Agreement will be governed by and construed in accordance with the Laws of the Province of Ontario, and Gillian Shields and the Client hereby attorn to the jurisdiction of the Courts of the Province of Ontario.
